Legislative requirements

We have been vetting our staff directly through the police. Can we continue to do this?

The Education Standards Act 2001 states that every new and existing non teaching member of staff must be vetted through the NZ Teachers Council.

Why do we have to pay $10 to police vet a person when we used to get it free through the police?

The legislation provides for the NZ Teachers Council to charge a fee to meet the administrative costs involved in processing vets.

Where in the Act does it say we have to use the Teachers Council?

See Section 78C of the Education Standards Act 2001. This can be found at www.legislation.govt.nz under E in Statutes.

Who should be vetted?

Do we need to vet contractors?

Yes. Contractors and sub contractors who work regularly in school grounds or early childhood centres during operating hours need to be vetted.

Do we need to vet Community Service workers?

This is the Court's responsibility.

Do training teachers and their tutors need to be vetted when they are in schools?

  • If they are not being paid by the Board of Trustees or management of the school, they are outside the criteria of non teaching police vetting.

  • If they are being paid and have been through any registration process through the NZ Teachers Council (LAT, provisional, subject to confirmation or full registration) they will have already been vetted through that system.

  • If they are being paid but have no registration through the NZ Teachers Council, they are required to be vetted through the non teacher police vetting process.

Do GAP students working in schools need to be vetted?

If they are paid staff members then yes they must go through a police vet for any history within New Zealand. Whether they need to provide you with a police clearance from overseas is your decision to make. You may want to seek advice from NZSTA or the Ministry of Education in this matter.

If an employee holds a Limited Authority to Teach (LAT) do they need to be vetted?

If an employee holds a current LAT they have already completed the vetting process when their application was approved by the NZ Teachers Council.

Do homestays need to be police vetted?

This does not fall under non teacher police vetting criteria and is up to the discretion of individual schools. More information can be found at www.educationnz.org.nz

We are part of the International Code of Practice. The Ministry requires us to provide a letter from the Vetting Service to confirm we do have a vetting process in place. Can you provide me with the letter?

The vetting of staff members for the International Code of Practice does not come through the NZ Teachers Council. The letter you need to provide the Ministry is from the Vetting and Validation section of the NZ Police. Go to www.police.govt.nz

We have volunteers who work on site during hours of operation; do we need to have them vetted through the NZ Teachers Council?

No. Volunteers are not vetted through the NZ Teachers Council. However if you wish to have your volunteer workers vetted you can do so through the Vetting and Validation section of NZ Police www.police.govt.nz

I manage an early childhood centre and am also the vet requestor. My sister works one day a week; does she still need to be vetted?

Yes. Any person who is employed at the centre on a regular basis needs to be police vetted. Because you are related to the applicant an alternative vet requestor is required from your centre to receive the results. You cannot receive the results of someone you are related to. The same applies to schools.

I am the parent of a student going on a school camp for two weeks; do I need to be police vetted?

No. Because you are not a paid staff member you would not be vetted through the NZ Teachers Council. However if the school wishes to have you vetted they could do so directly with the Vetting and Validation section of NZ Police.

If I am a registered teacher holding a current practising certificate but I am currently in a non teaching position (e.g. School Librarian, Secretary) do I have to complete a Non Teacher Police Vet?

If you are employed in the same school but have chosen to take a new non teaching position you would not need to complete a Non Teacher Police Vet. Once your practising certificate expires you would need to complete a Non Teacher Police Vet.
However if you accept a non teaching position in a different school you would then be required to complete a Non Teacher Police Vet.

What is the legal age at which a non teacher police vet can be carried out?

The legal age at which a police vet can be completed is 17 years old and over.

Processes

Can we photocopy application forms?(TCNTPV/03)

Yes you can. Please ensure all applicants also receive a copy of the information sheet, this is also available in the NZ Teachers Council website.

Is there any way to fast-track an application?

The NZ Teachers Council will always endeavour to return police vets as fast as possible, but there is a third party involved in the process (the police) and we cannot control their system. We cannot fast track applications.

Can we send in a bulk payment of, say, $200.00 so the Teachers Council can tick off applications as they receive them?

No. The NZ Teachers Council doesn't have the facilities for this pre payment option at this stage, and to do so would increase the administration cost. We will only process application forms that we receive with the correct payment.

How often do we need to police vet our staff?

Non teaching staff need to be police vetted by the school or early childhood centre every three years; on or about the third anniversary of the last completed vet by that school or early childhood centre.

What do the results look like when we get them back?

The police stamp the bottom right-hand corner of the application form, and then date and initial it. If there are any criminal convictions they will be attached to the form in a separate printout.

What information does the NZ Teachers Council keep after the vet results have been sent to the school and the applicant?

The NZ Teachers Council does not keep a copy of the results, to protect the privacy of all individuals concerned. The only information kept on the database is that which is in Sections A and B on the application form.

Does the Teachers Council keep any statistics?

No. The NZ Teachers Council is only employed to monitor the processing of the police vets.

I have received back my application with results from NZ Police; why has my traffic history been included?

Vet results include both traffic convictions and criminal history. This may be impacted by the Criminal Records (Clean Slate) Act 2004.

Who do I make the payment out to for a Non Teacher Police Vetting application?

The fee is $10.00 payable to the NZ Teachers Council. The payment must be sent in with the application before it can be processed.

Who sees the results of a police vet?

Once an application has been processed by NZ Police two copies of the application are sent out by the NZ Teachers Council. The original is sent to the applicant and a photocopy to the designated vet requestor.Under the Educations Standards Act 2001 Schools and centres are required to have a secure process to deal with the vet results.

How do I go about...

We have already vetted all our staff through the courts, so why do we have to vet them all again through you?

The legislation requires all non teaching staff to be vetted through the NZ Teachers Council. Refer to the Education Standards Act 2001.

I am a contractor and work in many different schools. Can I fill out the form myself and get myself vetted so I can show the results to the schools?

No. A contractor and their staff must be police vetted through the NZ Teachers Council by each school or early childhood centre in which they are employed.

I am the vet requestor of a school/early childhood centre and need to be police vetted. Can I fill out the application form for myself and be the vet requestor?

No. if you are the vet requestor then you need to designate someone employed in the school/early childhood centre and in a position of authority to complete Part B of the form and receive your results as the vet requestor.
As an employer you cannot receive your own results.

What happens if I wish to question the vet result I received?

You would contact NZ Police in writing with the concerns you have regarding the results of the police vet. Address your concerns to;

Employment issues

Can we employ someone before we have the police vet results?

Refer to Section 78 of the Education Standards Act 2001.
Schools need to contact the New Zealand Schools Trustees Association to seek advice on this issue www.nzsta.org.nz
Early childhood centres need to contact the Ministry of Education www.minedu.govt.nz

Do we need to vet all applicants for a job or just the successful one?

An internal procedure should be set up within the school for dealing with this. Any further information can be gained through NZSTA.

What do we do if someone we vet has convictions?

This is an employment issue, therefore you should contact NZSTA or the Ministry of Education or seek legal advice in this situation.

Why do non teachers get their vet results but teachers don't?

The process for non teaching staff is a separate process than that for teachers. Non teacher employment issues are the school's responsibility, rather than the NZ Teachers Council's.

What do I do if a member of my staff or an applicant refuse to be police vetted?

The Education Standards Act 2001 states that all non teachers must be police vetted through the Teachers Council. Contact NZSTA or seek legal advice in this situation. It is a legal condition of employment.
